Terms of use

The rules for using this website and the platform — for visitors, Stars and brands.

About these terms

These terms are an agreement between you and [Legal entity name], [Registered office address] (“we”, “us”), which operates Elamp Stars. By using the website or the platform you accept them. If you use it for an organisation, you confirm you may bind it. Our privacy notice explains how we handle personal data.

Accounts

  • Stars and brands join by invitation. You sign in with your own Google account and keep it secure; you are responsible for what is done with it.
  • Some actions — signing a licence, approving an ad, changing bank details, paying, sending money — need you to confirm it's you. Don't let anyone else do this for you.
  • Tell us straight away at [legal contact email] if you think your account has been used without permission.
  • We may suspend an account to protect a Star, a brand or the platform, and will tell you why unless the law prevents it.

Stars

A Star's participation is governed by the likeness licence they sign in the app. It sets what their likeness (and voice, if included) may be used for, where, in which languages and channels, for how long and for what share of each fee — and that nothing is published without their approval of the exact ad. If the licence and these terms differ, the licence wins.

Brands

Offers

  • You can request a Star only within the scope of their licence. Your offer goes to that Star, who may accept, decline or counter; you may accept a counter, make a new offer or decline it.
  • A campaign is agreed when the Star accepts. The agreed fee, scope, dates and ads are recorded on the campaign.

Payment and refunds

  • You pay the agreed fee plus GST before we start making your ads. We issue a GST tax invoice for every payment.
  • If you cancel before we start making your ads, we refund everything. After that, we keep the production fee shown before you pay (normally 20% of the fee) and refund the rest, with GST in proportion, and issue a credit note. The percentage you agreed at payment is the one that applies.

Approvals and use of ads

  • Every ad passes our quality check, your review and the Star's approval of the exact file. Only approved files may be used.
  • You may use each approved ad only for your brand and product, in the territories, languages and channels, and between the dates of that campaign. Editing it (other than resizing or adding your own end card without changing how the Star appears or what they say), reusing it in another campaign, or using it after the dates needs a new agreement and the Star's approval.
  • Don't remove or alter the content credentials (provenance information) we attach to ads.
  • When the campaign ends, stop placing the ads. Ads already published may stay where removing them isn't practical, but must not be promoted further.

Your claims and compliance

  • You are responsible for your product and every claim in your brief: it must be true, substantiated, and lawful, including under the Consumer Protection Act, 2019, its endorsement guidelines, and the ASCI Code. Stars may ask for proof of claims before approving.
  • Where you publish, you must follow the platform's advertising policies and any law that applies to AI-generated or altered content, including any disclosure or labelling it requires.
  • You confirm you have the rights to everything you give us (logos, product images, guidelines) and that they show no real person other than the Star.

What nobody may do

  • Create, request or publish content showing a real person without their licence through this platform.
  • Try to get around a Star's approval, our verification, or our AI provider's safeguards — for example by uploading photos or video of a real face.
  • Use the platform or any ad for anything unlawful, deceptive, defamatory, sexual, hateful, political or religious, or to target children.
  • Scrape, attack, overload or reverse-engineer the platform, or access another person's account or data.

Reporting fakes

Anyone can report content that uses a Star's face without permission through our contact page. We act on reports for the Stars we represent; we can't act for people we don't represent.

Who owns what

  • Stars keep all rights in their name, face, voice and personality.
  • You keep the rights in your brand, logos and materials, and give us permission to use them to make your ads.
  • The ads are licensed to you for the agreed campaign; they combine the Star's licensed likeness with your materials, so neither side may use them beyond it.
  • We own the platform, our website and our brand.

Availability and changes

We work to keep the service available and correct, but it is provided as it is, and AI-generated output can be imperfect — which is why every ad is reviewed and approved before use. We may change features; if we change these terms in a way that matters, we'll tell you before it takes effect.

Liability

  • Nothing in these terms limits liability that can't be limited by law, or for fraud or deliberate misconduct.
  • Otherwise, we are not liable for indirect or consequential loss, or lost profits, and our total liability is limited to the fees you paid us in the 12 months before the claim.
  • Brands are responsible for — and will compensate us and the Star for — claims arising from their product, their claims or their use of ads beyond what was approved.

Law and disputes

These terms are governed by the laws of India. We'll first try to resolve any dispute in good faith; if that fails within 30 days, the courts at [City] have exclusive jurisdiction.
